These Terms of Service ("Terms") govern your access to and use of the PAWWSIBLE website, platform, APIs, and services (collectively, the "Service"), provided by PAWWSIBLE ("Company," "we," "us," or "our"). Please read these Terms carefully before using our Service. By creating an account, subscribing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. 1. Description of the Service PAWWSIBLE provides a unified interface and a single subscription that allows users to access and utilize various third-party generative artificial intelligence models and agents ("Third-Party AI Models"), such as those provided by OpenAI, Google, Anthropic, and others. Our Service acts as a wrapper or aggregator, streamlining access and billing for these underlying technologies. We do not create the outputs from these models; we provide the means to access them. 2. User Accounts Eligibility: You must be at least 18 years old and capable of entering into a binding contract to use the Service. Registration: You agree to provide accurate, current, and complete information during the registration process. Security: You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. 3. Subscriptions, Payments, and Cancellation Subscription Plans: The Service is offered on a subscription basis for various tiers. Features and usage limits for each tier are described on our pricing page. Billing: By subscribing, you authorize us to charge your chosen payment method on a recurring basis (e.g., monthly or annually) for the subscription fee. All fees are quoted in [e.g., US Dollars]. Content: Your Inputs and AI Outputs Your Inputs: You own all the text, prompts, documents, or other information you provide to the Service ("Inputs"). You grant us a worldwide, non-exclusive, royalty-free license to use, process, and transmit your Inputs solely for the purpose of providing the Service to you. This includes sending your Inputs to the underlying Third-Party AI Models for processing. AI Outputs: The Service generates responses and content based on your Inputs ("Outputs"). The ownership of Outputs is a complex and evolving area of law. To the extent permitted by law and the terms of the underlying Third-Party AI Models, you own the Outputs you generate. Responsibility for Content: You are solely responsible for your Inputs and how you use the Outputs. You agree not to use the Service to generate content that is illegal, harmful, infringing on intellectual property rights, or violates our Acceptable Use Policy (Section 5). Accuracy Disclaimer: The Third-Party AI Models we provide access to are experimental. You acknowledge that Outputs may be inaccurate, incomplete, offensive, or biased. We do not guarantee the accuracy, quality, or reliability of any Outputs. You must evaluate Outputs for accuracy and appropriateness for your use case. 5. Acceptable Use Policy You agree not to use the Service to: Engage in any illegal activity or promote illegal activities. Generate content that is hateful, harassing, violent, or sexually explicit. Generate misinformation, disinformation, or spam. Infringe upon the intellectual property rights of others. Attempt to reverse-engineer, decompile, or discover the source code of the Service. Violate the terms of service or acceptable use policies of any of the underlying Third-Party AI Models (e.g., OpenAI, Google, etc.). A violation of their terms is considered a violation of our Terms. 6. Third-Party AI Model Dependency Our Service is fundamentally dependent on the availability and performance of the Third-Party AI Models. You acknowledge and agree that: We are not responsible for the performance, uptime, or availability of any Third-Party AI Model. The selection of available Third-Party AI Models may change at any time, with or without notice, based on our agreements with providers or their own platform changes. Your use of the Outputs is subject to any restrictions or terms imposed by the respective Third-Party AI Model provider. 7. Intellectual Property Excluding your Inputs and Outputs as described in Section 4, we and our licensors own all right, title, and interest in and to the Service, including all associated intellectual property rights (our website, branding, user interface, etc.). 8. Termination By You: You can terminate these Terms at any time by cancelling your subscription and ceasing to use the Service. By Us: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for any reason, including a breach of these Terms. 9. Disclaimer of Warranties & Limitation of Liability THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL [YOUR COMPANY NAME], ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF REVENUE, LOSS OF PROFITS, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR ANY OUTPUTS. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE TOTAL AMOUNT OF FEES, IF ANY, THAT YOU PAID TO US FOR THE USE OF THE SERVICE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. 10. Indemnification You agree to defend, indemnify, and hold harmless PAWWSIBLE and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including your Inputs and your use of Outputs. 11. Governing Law and Dispute Resolution These Terms shall be governed by the laws of [Your Jurisdiction (e.g., the State of Delaware, USA or Republic of Singapore)], without regard to its conflict of law provisions.
